Acceptance of Terms

By downloading, accessing, or using the MemeSwipe mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and MemeSwipe ("we," "us," or "our"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, by notifying you through the App or by email. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.

Eligibility

You must be at least 13 years old to use MemeSwipe. By using the App, you represent and warrant that you are at least 13 years of age. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

MemeSwipe is not available to users who have previously been suspended or removed from the platform for violating these Terms.

Your Account

To access most features of MemeSwipe, you must create an account. You agree to:

  • Provide accurate and complete information when creating your account.
  • Keep your login credentials secure and not share them with others.
  • Notify us promptly at memeswipe2026@gmail.com if you become aware of unauthorized access to your account.
  • Take responsibility for all activity that occurs under your account.

We reserve the right to terminate or suspend accounts that violate these Terms, at our sole discretion, with or without notice.

User Content

MemeSwipe allows you to upload, post, and share memes, images, captions, and comments ("User Content"). You retain ownership of the content you create and post.

By uploading or sharing User Content on MemeSwipe, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute that content solely for the purpose of operating, promoting, and improving the App. This license ends when you delete the content or your account, subject to any existing sharing or distribution that cannot reasonably be reversed.

You represent and warrant that:

  • You own or have the necessary rights and permissions to share the content you post.
  • Your content does not infringe any third party's intellectual property rights, privacy rights, or other legal rights.
  • Your content complies with these Terms and all applicable laws.

Acceptable Use Policy

MemeSwipe exists to make people laugh. To keep it that way for everyone, you agree not to use the App to:

  • Post, share, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Upload content that violates third-party copyrights, trademarks, or other intellectual property rights. This includes reposting content you do not have rights to without appropriate attribution or permission.
  • Share, solicit, or distribute sexually explicit content, particularly any content involving minors.
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
  • Engage in spam, unsolicited bulk messaging, or coordinated inauthentic behavior.
  • Attempt to interfere with, compromise, or disrupt the App's infrastructure, servers, or networks.
  • Use automated scripts, bots, or other non-human methods to access or interact with the App.
  • Collect or harvest user data without consent.
  • Use the App for any commercial solicitation without our prior written consent.

We reserve the right — but do not assume the obligation — to monitor User Content and to remove content that violates these Terms or that we find objectionable for any reason.

Intellectual Property

The MemeSwipe name, logo, design, and all original content produced by us are owned by MemeSwipe and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our proprietary content without our written consent.

If you believe that content on MemeSwipe infringes your copyright, please contact us at memeswipe2026@gmail.com with sufficient detail to identify the allegedly infringing material and your claim of ownership.

Account Termination

You may delete your account at any time through the App's settings. Upon account deletion, your profile and associated content will be removed from the platform.

We may suspend or permanently terminate your account at our sole discretion, with or without notice, for any conduct that we believe violates these Terms, harms other users, or is otherwise harmful to MemeSwipe or its community. Termination does not limit any other remedies we may have.

Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not endorse, verify, or take responsibility for any User Content posted by other users. Use of content from other users is at your own risk.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MEMESWIPE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID, IF ANY, TO USE THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Minnesota.

Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MemeSwipe with respect to your use of the App and supersede all prior or contemporaneous communications and proposals.
